APOA Member Agreement / APOA 会员协议

This Member Agreement (“Agreement”) sets out the terms and conditions for membership of Australia Property Owners Alliance (APOA). By registering as a member, you confirm that you have read, understood, and agree to this Agreement.

1. Membership Types

1.1 Free Membership

Available to any property owner or investor in Australia. Free members can access:

  • APOA newsletters and policy updates
  • General guides and educational resources
  • Community event information and registration
  • Basic landlord tools and templates

1.2 VIP Membership

VIP membership provides enhanced support and access, including:

  • Priority support from the APOA volunteer team
  • Access to VIP-exclusive content, templates, and guides
  • Early access to events and resources
  • Recognition as a supporting member of the community

VIP membership fees are used entirely to support APOA’s operational costs as a nonprofit community. Fees are published on the website and subject to change with 30 days notice to current VIP members.

2. Eligibility

Membership is open to individuals who:

  • Are 18 years of age or older
  • Own or have a genuine interest in property ownership or investment in Australia
  • Agree to abide by this Agreement, the Terms of Use, and Community Guidelines

APOA reserves the right to decline or revoke membership at its discretion, particularly where a member has violated these terms or acted contrary to the community’s values and interests.

3. Member Responsibilities

As an APOA member, you agree to:

  • Provide accurate and truthful information when registering
  • Keep your contact details up to date
  • Treat fellow members, volunteers, and staff with respect and courtesy
  • Not use APOA’s platform, events, or community channels for commercial promotion without prior written approval
  • Not share, distribute, or misuse other members’ personal information
  • Report any concerns about community conduct or safety to APOA volunteers
  • Comply with all applicable Australian laws in your use of APOA resources

4. Community Conduct

APOA is a respectful, inclusive community. The following are not permitted:

  • Harassment, bullying, discrimination, or threatening behaviour toward any member or volunteer
  • Sharing false or misleading information about property, tenants, or legal matters
  • Posting content that is defamatory, offensive, or illegal
  • Spamming, unsolicited promotion, or pyramid/referral scheme promotion
  • Impersonating other members, professionals, or organisations

Violations may result in removal from events, suspension, or termination of membership without refund.

5. Disclaimer of Professional Advice

APOA members acknowledge and understand that:

  • APOA is a community organisation run by volunteers, not licensed lawyers, financial advisers, or property managers
  • All information, guides, and discussions within APOA’s platform are for general community knowledge-sharing only
  • Nothing communicated by APOA or its members constitutes legal, financial, or professional advice
  • Members should always seek independent professional advice for their specific circumstances
  • APOA does not verify the accuracy of member-shared information and is not responsible for decisions made based on community discussions

6. Fees and Payments

6.1 VIP Membership Fees

  • VIP membership fees are clearly stated at time of purchase
  • Payments are processed securely through our third-party payment provider
  • Membership renews automatically unless cancelled before the renewal date
  • You will receive a reminder 7 days before renewal

6.2 Refund Policy

  • Free membership: no fees, no refund applicable
  • VIP membership: pro-rata refund available within 14 days of purchase if you are not satisfied, minus any transaction fees
  • Event registration fees: refundable up to 7 days before the event; non-refundable after that, though you may transfer your registration to another person
  • No refunds will be issued where membership has been terminated due to conduct violations

7. Privacy

APOA handles your personal information in accordance with our Privacy Policy, available at apoa.org.au. By becoming a member, you consent to receiving community communications. You may opt out of non-essential communications at any time.

8. Termination

8.1 By You

You may cancel your membership at any time by contacting APOA@apoa.org.au. Cancellation takes effect within 5 business days. For VIP members, the refund policy in Section 6.2 applies.

8.2 By APOA

APOA may suspend or terminate your membership with or without notice if you:

  • Breach any provision of this Agreement or the Terms of Use
  • Engage in conduct harmful to the community or other members
  • Provide false information at registration
  • Fail to pay applicable fees after reasonable notice

9. Limitation of Liability

To the fullest extent permitted by law, APOA’s total liability to any member for any claim arising from membership shall not exceed the total membership fees paid by that member in the preceding 12 months. APOA is not liable for indirect, consequential, or special damages.

10. Changes to This Agreement

APOA may update this Agreement from time to time. We will notify members by email at least 14 days before material changes take effect. Continued membership after that date constitutes acceptance of the updated Agreement.

11. Governing Law

This Agreement is governed by the laws of Victoria, Australia.

VIP 会员费用全部用于支持 APOA 作为非营利社区的运营开支。收费标准在网站上公示，如有变更将提前 30 天通知现有 VIP 会员。

二、申请资格

会员资格面向以下人士开放：

  • 年满 18 周岁的成年人
  • 在澳大利亚拥有或有意向拥有房产的业主或投资者
  • 同意遵守本协议、使用条款及社区行为准则

APOA 保留自行决定拒绝或撤销会员资格的权利，特别是在会员违反本条款或行为有悖于社区价值观和利益的情况下。

三、会员责任

作为 APOA 会员，您同意：

  • 注册时提供真实准确的信息
  • 及时更新您的联系方式
  • 以尊重和礼貌的态度对待其他会员、志愿者及工作人员
  • 未经事先书面批准，不将 APOA 平台、活动或社区渠道用于商业推广
  • 不分享、传播或滥用其他会员的个人信息
  • 如发现社区行为或安全方面的问题，及时向 APOA 志愿者反映
  • 在使用 APOA 资源时遵守澳大利亚所有适用法律

四、社区行为准则

APOA 是一个相互尊重、包容多元的社区。以下行为不被允许：

  • 对任何会员或志愿者进行骚扰、欺凌、歧视或威胁
  • 分享关于房产、租客或法律事务的虚假或误导性信息
  • 发布诽谤性、冒犯性或违法内容
  • 发送垃圾信息、未经请求的推广，或推销传销/拉人头项目
  • 冒充其他会员、专业人士或机构

违规者可能被禁止参加活动、暂停或终止会员资格，且不予退款。

五、专业建议免责声明

APOA 会员确认并理解：

  • APOA 是由志愿者运营的社区组织，非持牌律师、理财顾问或房产管理专业人士
  • APOA 平台内的所有信息、指南和讨论，仅供社区成员一般性知识分享之用
  • APOA 或其会员的任何沟通均不构成法律、财务或专业建议
  • 会员应就自身具体情况寻求独立的专业意见
  • APOA 不核实会员分享信息的准确性，对基于社区讨论所做决定不承担责任

六、费用及付款

6.1 VIP 会员费

  • VIP 会员费在购买时明确标示
  • 通过我们的第三方安全支付平台处理
  • 会员资格将自动续费，除非在续费日前取消
  • 续费前 7 天将向您发送提醒通知

6.2 退款政策

  • 免费会员：无费用，不适用退款
  • VIP 会员：购买后 14 天内如不满意，可申请按比例退款，扣除交易手续费
  • 活动报名费：活动前 7 天可退款；此后不予退款，但您可将名额转让给他人
  • 因违规行为被终止会员资格的，不予退款

七、隐私

APOA 依照我们的隐私政策处理您的个人信息。成为会员即表示您同意接收社区通讯。您可随时选择退订非必要通讯。

八、会员资格终止

8.1 您主动终止

您可随时发送邮件至 APOA@apoa.org.au 申请注销会员资格，注销将在 5 个工作日内生效。VIP 会员请参照第六条 6.2 款退款政策执行。

8.2 APOA 终止

如您出现以下情形，APOA 可能在不事先通知的情况下暂停或终止您的会员资格：

  • 违反本协议或使用条款的任何规定
  • 对社区或其他会员造成伤害
  • 注册时提供虚假信息
  • 经合理催告后仍未缴纳相关费用

九、责任限制

在法律允许的最大范围内，APOA 对任何会员索赔的总赔偿责任，不超过该会员在过去 12 个月内已缴纳的会员费总额。APOA 不承担间接、后果性或特殊损害赔偿责任。

十、协议变更

APOA 可能不定期更新本协议。重大变更将至少提前 14 天通过电子邮件通知会员。该日期后继续保持会员资格，即视为接受更新后的协议。

十一、适用法律

本协议受澳大利亚维多利亚州法律管辖。
